In Us We Trust: Katy Perry and Russell Brand Marry Without Prenup

In an intimate ceremony surrounded by close family and friends, pop superstar, Katy Perry, 25, married British comedian, Russell Brand, on October 23, 2010, in India.  The ceremony was the highlight of a six-day celebration, including a Bollywood-themed party on Friday night. In America, more than half of all marriages end in divorce.  Some marriages end in very ugly and bitter divorces.  Despite this well known fact, many Hollywood couples refuse to “kill the romance” with the P word: Prenup.  A prenuptial agreement is a contract between two people about to wed that spells out how assets will be distributed in the event of divorce or death.  As a California girl, Katy Perry will most likely settle with her new husband in her home state.  This will present a major problem for Perry in the event she and Brand divorce.  California is a community property state, where there is a presumption of equal division of property.  In a community property state, marriage is viewed as a community and each spouse is a member that contributes equally.  Upon divorce, each spouse has a right to equal division of property, although separate property that may have been owned or retained separately will not get distributed equally.  CA divorce law.  New York is not a community property state, but follows an equitable distribution system.  There are several factors weighed in determining what is equitable and fair.  Judges are afforded great discretion in rendering what may be “tough justice,” in that distribution may not necessarily be about equal distribution, rather it is about what is fair.  NY divorce law.  At the height of their careers, Perry and Brand stand to endure a complicated divorce should they awake from their “teenage dream.”
