New York law does favor either parent as having a preferred right to custody of their children. The court makes a custody decision in the “best interests of the child.” The court does not automatically assume that the mother is the better parent. The court will look at several factors, including who the “primary caretaker” of the child is. The court will also take into consideration the parents’ lives and the homes they would provide for the child. The course will take into consideration any allegations of domestic violence by either parent. The court will make each decision on a case by case basis.
