Wage and hour laws protect employees from being taken advantage of by their employers and ensure that workers receive the compensation to which they are entitled by the Fair Labor Standards Act (FLSA) and New York wage and hour laws, including compensation for travel time, where appropriate.
The FLSA and wage and hour laws typically require that your employer pays you for travel time outside of your normal working hours. If your regular shift is from 9 a.m. to 5 p.m., but you meet several other employees at your workplace in New York City at 6 a.m. to travel to an all-day seminar on Long Island, returning to the workplace at 6 p.m., then you are entitled to compensation for 12 hours of work (6 a.m. – 6 p.m.).
However, the rules are a little different if the seminar lasted several days. Passengers who were not working during the ride to and from the seminar would not be entitled to overtime pay or compensation for time outside their normal business hours. The driver, however, would be entitled to compensation because he or she is working by driving.
If you are required or requested to travel outside your normal work schedule or in addition to your normal work schedule, then you may be entitled to overtime pay and compensation. A jury in Queens, N.Y., this week awarded $15 million to a nurse who endured several years of unwanted sex talk, propositions and groping by a doctor that escalated to two sexual assaults against her in 2001. The verdict represents the largest sexual harassment judgment ever awarded to an individual in a New York state court.
